These Website and Hosted Service Legal Terms apply to the Easy Rent Pro website and the Easy Web Rent platform provided by Sunset Solutions N.V. They supplement the Terms of Service, accepted quotation, order form, Refund Policy, Cancellation Policy, Privacy Policy, and any signed data-processing or project agreement. Mandatory legal rights that cannot be excluded remain unaffected.
1. Introduction and acceptance
Easy Rent Pro makes this website, its text, images, demonstrations, documentation, downloads, APIs, software interfaces, forms, communications, and related materials available subject to these terms. By accessing the website, requesting a trial, creating an account, purchasing a subscription, or using Easy Web Rent, you agree to the applicable terms.
If you use the service on behalf of a company, you represent that you have authority to bind that company. If you do not agree, do not use the website or service.
2. Easy Web Rent hosted service
Easy Web Rent is a hosted and managed software service for rental operations. A subscription grants a limited, non-exclusive, non-transferable right to access the subscribed functions during the paid period. It does not transfer ownership of the platform, source code, database schema, infrastructure, security configuration, or underlying technology.
Features, limits, supported integrations, storage, users, vehicles, branches, domains, and support level depend on the selected plan, accepted quotation, and current product documentation.
3. Accounts and authorized users
Customers are responsible for keeping account information accurate, assigning appropriate roles, protecting passwords and multi-factor authentication methods, and promptly removing former employees or unauthorized users. Accounts may not be shared outside the subscribing organization except where expressly permitted.
The customer is responsible for activity performed through its accounts unless it promptly reports suspected compromise and the activity resulted from Easy Rent Pro’s breach of an applicable obligation.
4. Acceptable use
You may not use the website or service to:
- violate law, regulation, sanctions, privacy, consumer, employment, intellectual-property, or payment-card obligations;
- upload malware, exploit vulnerabilities, bypass access controls, interfere with availability, or perform unauthorized security testing;
- scrape, copy, reproduce, frame, republish, resell, sublicense, reverse engineer, decompile, or create a competing service from protected platform materials, except where such restriction is prohibited by law;
- send spam, deceptive communications, unlawful marketing, or messages without required consent;
- store content that is unlawful, infringing, defamatory, abusive, discriminatory, fraudulent, or harmful;
- use resources in a way that unreasonably affects other customers or infrastructure.
Reasonable automated use through documented APIs is permitted within the applicable account limits and API terms.
5. Intellectual property and website content
Easy Rent Pro and its licensors retain all rights in the website, Easy Web Rent platform, software, branding, designs, documentation, workflows, reports, database structure, APIs, templates, and original content. Third-party materials remain owned by their respective owners.
You may view and use public website content for legitimate evaluation and business purposes. Reproduction, redistribution, modification, commercial exploitation, or systematic extraction requires prior written permission unless permitted by law.
6. Customer Data
The customer retains its rights in business records and content entered into Easy Web Rent, including customer, driver, vehicle, reservation, rental, payment, document, image, and operational data (“Customer Data”). Easy Rent Pro does not acquire ownership of Customer Data merely because it is hosted in the service.
The customer is responsible for the lawfulness, accuracy, collection, notices, consents, retention, and use of Customer Data. The customer must not submit data it has no right to process.
Easy Rent Pro may process Customer Data only to provide, secure, support, maintain, improve, and comply with legal obligations relating to the service, as described in the Privacy Policy and any applicable data-processing agreement.
7. Data access, exports, and server credentials
Customer Data is accessible through the application’s screens, reports, APIs, and standard export functions included in the subscribed plan. Upon written request, Easy Rent Pro may provide available data exports in CSV, Excel, PDF, or another reasonable format.
Subscription fees do not include a separate hosting account, cPanel/WHM access, FTP/SFTP access, SSH access, server administration rights, source files, server images, encryption keys, or direct database credentials. Those restrictions protect shared infrastructure, proprietary components, and security controls.
Custom extracts, migrations, reports, or data preparation not included in standard functions may be charged as professional services.
8. Security and backups
Easy Rent Pro uses administrative, technical, and organizational measures intended to protect the service and personal data. No internet transmission, software, or storage system can be guaranteed completely secure or continuously available.
Internal backups are maintained for operational continuity and disaster recovery. They are not a customer-controlled archival service and do not replace the customer’s responsibility to keep exports or copies needed for legal, accounting, or business-continuity purposes.
Security architecture, backup locations, encryption materials, private configuration, and internal credentials are confidential and are not disclosed where doing so would weaken protection.
9. Third-party services and links
Easy Web Rent may connect to payment processors, email providers, messaging services, mapping tools, GPS platforms, accounting systems, Microsoft, Google, Meta, Stripe, and other third parties. Their services are governed by their own terms and privacy practices.
Easy Rent Pro is not responsible for third-party availability, changes, pricing, content, or processing outside its control. The customer is responsible for maintaining valid third-party accounts, credentials, and permissions.
10. Communications
We may send service, security, billing, legal, renewal, support, and operational communications necessary for the account. Marketing communications are sent according to applicable law and stated preferences. Marketing consent may be withdrawn without affecting essential service communications.
11. Monitoring and enforcement
Easy Rent Pro may monitor service performance, logs, usage, and submitted content to maintain security, investigate abuse, enforce terms, provide support, and comply with law. Monitoring is limited to legitimate operational purposes and applicable privacy obligations.
We may remove unlawful content, restrict functions, suspend accounts, revoke API tokens, or terminate access where reasonably necessary under the Terms of Service or Cancellation Policy.
12. Availability and changes
The service may be unavailable for maintenance, upgrades, security action, supplier outages, emergencies, internet failures, or events beyond reasonable control. Features may evolve, be replaced, or be discontinued. Material changes affecting paid functionality will be handled according to the applicable agreement and law.
13. Warranties and disclaimers
Except for express commitments in an accepted agreement and rights that cannot be excluded, the website and service are provided “as is” and “as available.” Easy Rent Pro does not guarantee uninterrupted operation, complete error-free performance, suitability for every business process, or compatibility with every third-party system.
The customer remains responsible for verifying calculations, rates, taxes, legal forms, rental agreements, insurance requirements, regulatory obligations, and business decisions produced or supported by the system.
14. Limitation of liability
To the maximum extent permitted by law, Easy Rent Pro is not liable for indirect, incidental, special, punitive, exemplary, or consequential losses, including lost profit, lost revenue, loss of goodwill, business interruption, or loss resulting from third-party services.
Any aggregate liability limitation, exclusions, service credits, or claim period stated in a signed agreement or accepted order applies. Nothing excludes liability that cannot lawfully be excluded, including liability for fraud or intentional misconduct where applicable.
15. Customer responsibility and indemnity
To the extent permitted by law, the customer will defend and indemnify Easy Rent Pro against third-party claims arising from unlawful Customer Data, the customer’s breach, infringement, misuse of the service, unauthorized communications, or failure to obtain required notices and consents.
16. Suspension and termination
Access may be suspended or terminated for non-payment, chargeback, security risk, unlawful use, material breach, excessive resource consumption, or conduct that threatens the platform or others. Details concerning cancellation, data export, account closure, and reactivation appear in the Cancellation Policy.
17. Applicable law and disputes
The governing law, jurisdiction, and dispute process stated in an accepted agreement or order form apply. Where no separate written term exists, the relationship is governed by the laws applicable to Sunset Solutions N.V. in Curaçao, subject to mandatory rights and jurisdictional rules that cannot lawfully be displaced.
18. Changes and severability
We may update these terms to reflect product, legal, security, or operational changes. Material changes will be communicated where required. If a provision is invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue in effect.
